Relocating to Kenya: A Legal Guide for Expatriates and Foreign Investors

Kenya has become an increasingly attractive destination for expatriates, foreign investors, and regional professionals. Its position as East Africa's commercial hub, combined with a relatively stable legal environment, draws thousands of foreigners to the country each year. However, navigating Kenya's immigration framework requires careful planning.

Work Permits and Passes

Foreign nationals who wish to work in Kenya must hold a valid work permit or pass issued under the Kenya Citizenship and Immigration Act. There are several classes of permits depending on the nature of your work — whether you are employed by a local company, running your own business, or working as a dependent spouse. Applications are made through the Department of Immigration Services, and supporting documents typically include a valid passport, academic certificates, a letter of employment or business documents, and evidence of the employer's compliance status.

Special Passes and Dependant Passes

Spouses and children of work permit holders can apply for dependant passes, which allow them to reside in Kenya but do not automatically confer the right to work. A special pass may be issued to a person awaiting a formal work permit or for specific short-term assignments.

Class G Permits for Investors

Foreign investors seeking to establish or invest in a Kenyan business typically apply for a Class G permit. Eligibility criteria include proof of investment capital, a business plan, and in some cases evidence that the role cannot be filled by a qualified Kenyan national.

Citizenship and Naturalization

Foreign nationals who have resided lawfully in Kenya for a prescribed period may apply for citizenship by naturalization. Kenya also recognizes citizenship by birth and by registration in specific circumstances, including for spouses of Kenyan citizens.
