How to Obtain a Temporary Work Permit in Kenya (Special Pass Guide)

Foreign nationals intending to work or conduct short-term business activities in Kenya must comply with immigration laws. One of the most practical short-term solutions is the Kenya Special Pass, a temporary work permit allowing lawful engagement in limited professional or business activities for up to six (6) months.

This guide explains the procedure, requirements, and key legal considerations when applying for a Special Pass in Kenya.

What is a Kenya Special Pass?

A Kenya Special Pass is a short-term immigration authorization issued to foreign nationals to allow them to remain in Kenya while:

  1. Awaiting processing of a work permit;
  2. Applying for review of a denied permit;
  3. Conducting temporary consultancy, trade, or business; or
  4. Undertaking any other approved short-term activity.

It is issued under Regulation 34 of the Kenya Citizenship and Immigration Regulations, 2012.

Who Needs a Temporary Work Permit in Kenya?

You may need a Special Pass if:

  1. You intend to work in Kenya before obtaining a full work permit;
  2. Your work permit application is pending approval;
  3. You are engaged in short-term consultancy or project work;
  4. You need to regularize your immigration status.

Step-by-Step Procedure for Applying for a Kenya Special Pass

1. Prepare the Required Documents

Ensure you have the following:

  1. Completed and signed Form 32 (Special Pass Application Form);
  2. A detailed cover letter addressed to the Director of Immigration Services;
  3. Two recent passport-size photographs;
  4. Copy of the passport bio-data page;
  5. Proof of current immigration status (if in Kenya);
  6. Copy of the registration certificate of the company/organization;
  7. Certified academic and professional certificates;
  8. Translated documents (if not in English) by either the Embassy, a Notaries Public, or authorized /recognized institution;
  9. Copies of any previous permits or passes;
  10. Proof of pending applications (if applicable);
  11. Relevant clearance letters;
  12. Completed application checklist.

2. Submit the Application

Applications for a temporary work permit in Kenya are submitted to the Directorate of Immigration Services either:

  1. Physically; or
  2. Through the official online immigration platform.

3. Pay Government Fees

Applicants must pay the prescribed Special Pass fee. Always retain proof of payment.

4. Application Review Process

The immigration authorities will review your application and may request additional documents or clarification.

5. Issuance of the Special Pass

Once approved, the Special Pass is issued for a period not exceeding six (6) months, specifying:

  1. The approved activity;
  2. Duration of stay.

Take note that:-

  1. A Special Pass is a temporary work permit and does not replace a full work permit;
  2. You must only engage in the approved activity;
  3. Overstaying is an immigration offence under Kenyan law;
  4. Apply for a full work permit before expiry if continued stay is required.

Why Legal Guidance Matters

Errors in documentation, unclear purpose of stay, or non-compliance with immigration requirements can lead to:

  1. Delays in processing;
  2. Rejection of applications;
  3. Legal penalties or removal from Kenya.
